Forgewall — Terms & Conditions

These Terms & Conditions explain the terms under which Forgewall provides website design, development, hosting, maintenance and related services.

By purchasing services from Forgewall, you agree to these Terms & Conditions.

1. About Forgewall

Forgewall provides website design and development services, primarily for businesses and tradespeople.

In these Terms & Conditions, “Forgewall”, “we”, “us” and “our” refers to Forgewall. “Client”, “you” and “your” refers to the person or business purchasing our services.

2. Our Services

Our standard website service includes:

  • Website design and development

  • Mobile-responsive design

  • Website hosting

  • SSL/security

  • Domain connection assistance

  • Basic website maintenance

  • Minor content updates

  • Technical support relating to the website

The exact design, features and content of each website will be agreed with the client before development begins.

Additional pages, features, functionality or substantial changes outside the agreed service may incur an additional charge. We will discuss and agree any additional charges with you before carrying out the work.

3. Pricing and Payment

Our standard pricing is:

£299 one-time setup fee

£49 per month ongoing service

The £299 setup fee covers the initial design and development of the agreed website.

The £49 monthly fee covers ongoing hosting, maintenance, security and reasonable minor updates.

Monthly payments are recurring payments and will normally be processed automatically through our payment provider.

All prices are stated in GBP and include any applicable taxes unless otherwise stated.

We reserve the right to change our prices for future services. Existing customers will receive reasonable notice of any change to their recurring monthly price.

4. What's Included

Reasonable minor updates are included within the monthly service.

Examples include:

  • Updating contact details

  • Changing opening hours

  • Replacing existing images

  • Updating small amounts of text

  • Updating existing service information

The monthly service does not include substantial redesigns, new website sections, complex functionality or major development work.

Examples of additional work include:

  • Creating substantial new pages

  • Major redesigns

  • E-commerce functionality

  • Booking systems

  • Complex integrations

  • Custom functionality

  • Significant changes to the website structure

Additional work will be discussed and priced before being carried out.

5. Client Responsibilities

The client is responsible for providing accurate information, images, branding, logos, contact details and other materials required to create the website.

The client must ensure that they have permission to use any images, text, logos, trademarks or other materials supplied to Forgewall.

The client is responsible for ensuring that information relating to their business, services, prices and legal requirements is accurate.

Forgewall is not responsible for delays caused by the client failing to provide required information, content or approvals.

6. Website Design and Approval

We will work with the client to create a website based on the agreed requirements.

The client will have a reasonable opportunity to review the website before it is published.

Once the client has approved the website, further substantial changes may be treated as additional work.

We aim to ensure websites are functional and responsive across commonly used modern devices and browsers. However, we cannot guarantee identical appearance across every device, browser or future software update.

7. Domain Names

Where appropriate, Forgewall can assist with connecting a client's domain name to their website.

The client remains responsible for ensuring that they have the legal right to use their chosen domain name and business name.

Domain registration and renewal costs are not included unless explicitly stated as part of the agreed service.

8. Hosting and Third-Party Services

Website hosting and other technical services may rely on third-party providers.

These may include hosting providers, domain registrars, payment providers, email providers, analytics services and other software platforms.

We will take reasonable steps to maintain the website, but we cannot guarantee uninterrupted availability of third-party services.

Third-party services may have their own terms, fees, policies and limitations.

9. Ownership

The client's own business materials remain the client's property. This includes their logo, photographs, written business information and other content supplied by them.

While the client maintains an active monthly service with Forgewall, Forgewall retains ownership of the website design, development work, templates and systems used to provide the service, unless otherwise agreed in writing.

The client does not receive automatic ownership or transfer of the website's underlying design or development work simply by paying the initial setup fee.

10. Cancellation

The monthly service is provided on a month-to-month basis.

The client may request cancellation of the monthly service at any time.

Cancellation will normally take effect at the end of the current paid billing period, unless otherwise agreed.

There is no minimum contract period unless a separate written agreement states otherwise.

11. Website Handover Following Cancellation

If the client cancels their monthly service, the website will no longer be maintained or hosted by Forgewall once the relevant service period ends.

The client may request a website handover or transfer.

A one-off handover fee may apply depending on the website, hosting arrangements, third-party services and work required to complete the transfer.

The applicable handover fee will be agreed with the client before the transfer takes place.

Third-party licences, subscriptions, domains or services may need to be transferred or purchased separately.

12. Failed or Overdue Payments

If a payment fails or becomes overdue, we will contact the client and provide a reasonable opportunity to resolve the issue.

If an outstanding payment remains unpaid after reasonable notice, Forgewall may suspend hosting, maintenance and other services until the account is brought up to date.

We will not intentionally permanently delete a client's website solely because of a temporary payment failure without first providing reasonable notice.

13. Intellectual Property

Forgewall retains ownership of its own original website designs, templates, systems, processes and development materials unless otherwise agreed in writing.

The client retains ownership of content and materials they provide to Forgewall.

The client grants Forgewall permission to use supplied materials solely for the purpose of providing the agreed services.

14. Portfolio Use

Unless the client specifically asks us not to, Forgewall may display completed websites in its portfolio, promotional materials and website to demonstrate our work.

We will not knowingly disclose confidential information belonging to the client.

If a client requires their website or business information to remain confidential, they can contact us to discuss this.

15. Website Content and Legal Compliance

The client is responsible for ensuring that their business and website comply with applicable laws and regulations.

This may include:

  • Business licences

  • Industry-specific regulations

  • Pricing information

  • Advertising claims

  • Privacy notices

  • Cookie requirements

  • Copyright and image permissions

  • Any other legal requirements applicable to their business

Forgewall provides website development services and does not provide legal, tax, accounting or regulatory advice.

16. Availability and Technical Issues

We aim to keep websites available and functioning properly, but we cannot guarantee uninterrupted service.

Temporary outages may occur because of maintenance, hosting issues, domain issues, third-party services, internet connectivity or circumstances outside our reasonable control.

We will make reasonable efforts to resolve problems affecting websites we manage.

17. Liability

We will provide our services with reasonable care and skill.

To the extent permitted by law, Forgewall will not be responsible for indirect losses, loss of profits, loss of business, loss of opportunity or losses caused by circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.

18. Privacy

We collect and use personal information in accordance with our Privacy Policy.

Our Privacy Policy explains what information we collect, why we collect it, how we use it and your data protection rights.

Our Privacy Policy is available on the Forgewall website.

19. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal requirements.

Where a change materially affects an existing customer's ongoing service, we will provide reasonable notice.

20. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be handled in accordance with the applicable laws and courts of England and Wales.
